YOUR CONTINUED USE OF OUR SERVICES INDICATES THAT YOU HAVE THE REQUISITE AUTHORITY TO ENTER INTO AND HAVE BOTH READ AND ACCEPT THESE REWARD PROGRAMME TERMS, WHICH ARE ALSO INCORPORATED UNDER OUR FOLLOWING TERMS AND CONDITIONS (collectively “T&Cs”):

1.  DEFINITIONS  

For the purposes of our T&Cs

1. Content includes, but is not limited to, any information, data, communication, commentary, videos, stock images or footage, materials, writings, icons, text, graphics, lay-outs, images, sound clips, trade names, logos, domains, location data, trademarks and other intellectual property posted on the Platform by a User.

1. Discover Sport”, “us”, “our” or “we” means Discover Sport (Pty) Ltd (Registration number: 2023/921669/07) having its registered address at 76 Kyalami Boulevard, Kyalami Park, Gauteng, South Africa, and the owner of the Discover Sport Services;

1. Platform includes any website and/or any related (and/or enhanced) mobi-sites, software applications, embeddable video players or any other portals specifically made available by Discover Sport in relation to this platform;

1. Services includes the provision of the Platform to Users, the Discover Sports Rewards Programme and any supporting services;

1. Uploaders are those persons who create an account and post and/or upload Content to the Discover Sport Platform;

1. Users are both Uploaders and Viewers (including anyone who browses, scrapes, crawls or in any way uses the Platform);

1. Viewers are those persons viewing any Content of Users on the Platform; and 

1. You means, unless the context indicates otherwise, any User of our Services.
   

2.1.  General

In order to be eligible for our rewards programme, you are required to have a registered account on the Discover Sport Platform. All Uploaders are therefore automatically entered into our rewards programme and eligible to participate (subject to 2.2 and 2.3 below). If you do not want to be part of the rewards programme, please contact us at [insert email].

2.2.  Age Requirement

You must be at the legal age of majority in your country of residence to participate in our rewards programme. By using our Services, you warrant that you have full legal capacity to do so, to share your personal information and to sign up to our T&Cs.

2.3.  Parent or Guardian Consent

If you are not the legal age of majority in your country of residence, you must have your parent or legal guardian’s permission to participate in our rewards programme. Please have them read the T&Cs.

If you are a parent or legal guardian of a minor User, by allowing your child to use the Services and therefore participate in our rewards programme, you are subject to our T&Cs and responsible for your child’s activity on our Services.

2. place certain assumptions of risk on you (including certain undertakings and indemnifications) towards us and/or other third parties; and  
   
3. includes certain admissions of facts.
   

It is therefore important that you read them carefully.

Nothing in the T&Cs is intended to contravene the applicable provisions of the Consumer Protection Act, 2008 or any similar legislation in any applicable jurisdiction. These T&Cs must be treated as being qualified, to the extent necessary, to ensure compliance with all applicable laws.

1. By registering on the Discover Sport Platform;
   
2. By supplying additional demographic information on your profile (age, location, gender etc.)
   
3. By rating the Discover Sport Platform on the applicable app store;
   
4. By referring a friend using your unique link;
   
5. By opting in to receive direct marketing from Discover Sport;
   
6. By watching a full advert instead of skipping it;
   
7. By engaging with Content e.g. viewing, liking and commenting on Content;
   
8. By completing surveys and providing feedback;
   
9. By logging in daily or on consecutive days;
   
10. By ⁠interacting with and rating recommended Content;
    
11. By sharing Content to social media; and/or
    
12. By winning Platform competitions.
    

The Uploader can redeem ByteBucks for rewards: 

1. online, via the Platform; or 
   
2. by contacting Discover Sport at [insert email].
   

All Bytebucks issued are valid for a period of three years from the date the were issued by Discover Sport.

The Uploader cannot reverse, cancel or amend a redemption request once received and/or effected by Discover Sport, without Discover Sport’s prior written consent and assistance.

The Uploader will bear all risk and liability for any reward received in terms of the rewards programme and to the extent that there is any dispute regarding any reward, such dispute must be settled between the relevant partner and the Uploader directly.

Rewards are subject to availability and in accordance with such restrictions, limitations, rules, procedures, charges or exclusions as may be applicable from time to time. All reservations and/or other arrangements relating to the reward must be confirmed directly with the partner. The Uploader will be obliged to comply with the partner’s own terms and conditions (as may be applicable) with effect from the redemption date.

The Uploader must ensure that s/he is familiar with the rewards terms and conditions of all partners and is responsible for any cost, charge or expense incurred pursuant to the redemption of ByteBucks in terms of the rewards programme. Partners' terms and conditions regarding earning and redeeming rewards may vary. Each partner’s terms and conditions are available on their website.

The number of ByteBucks required for a reward may be varied from time to time by Discover Sport in its sole discretion by reasonable prior notice.

Other than as required by applicable law, Discover Sport will not be responsible for issuing or procuring any tax or other certification, clarification or directive to or on behalf of the Uploader or a partner or any third party, or be responsible for any tax liability of the Uploader, a partner or any third party or other government charge arising from the rewards programme.

The Uploader is fully responsible for any tax implications arising from or associated with the receipt, accumulation, transfer, redemption or spend of any rewards as a result of his/her participation in the rewards programme and should obtain independent professional tax advice in this regard.

The Uploader agrees that Discover Sport will not be liable for, and fully indemnifies Discover Sport and holds Discover Sport harmless against, all damages, claims and fines made against the Uploader or Discover Sport, to the extent to which such damages, claims and fines arise out of or are connected to any taxation relating to the receipt, accumulation, transfer, redemption or spend of ByteBucks or any rewards.

You may terminate the Services at any time by deleting your account. You may furthermore opt out of our rewards programme at any time, by contacting us at [insert email].

Discover Sport reserves the right to cancel the rewards programme in its entirety upon three months’ notice to the Uploader.

Discover Sport may modify, suspend, or terminate your access to or use of our Services, including our rewards programme, anytime for any reason in our sole discretion, including, but not limited to, in the event of fraud, abuse of rewards privileges, where we believe you have breached any of our T&Cs or caused, or may cause, harm or loss to us, our Users or any third parties.

In the case of termination or cancellation, any unredeemed ByteBucks may be forfeited subject to applicable law.

The Uploader waives any rights s/he may have against Discover Sport arising directly or indirectly from or connected with or related to any loss or damage of whatsoever nature, which may be suffered as a result of the rewards programme, the redemption of ByteBucks, any reward or related matter, or the acts or omissions of any partner.

The Uploader agrees that Discover Sport is not responsible for any death or injury or direct or consequential loss or damage (including loss of profits or data) arising from the rewards programme.

An Uploader may not cede, delegate or otherwise transfer any rights or obligations arising from these Rewards Programme Terms without Discover Sport's prior approval, which approval will be at Discover Sport's sole discretion.

If any of the provisions in the Rewards Programme Terms are found to be invalid or unenforceable, such provisions will be severable from the remaining provisions, which will remain in full force and effect.

The Uploader accepts that Discover Sport may in its discretion from time to time and upon notice to the Uploader amend, replace, suspend, substitute or terminate the Rewards Programme Terms, the rewards programme and/or any of the partners.
