YOUR CONTINUED USE OF OUR SERVICES INDICATES THAT YOU HAVE BOTH READ AND ACCEPT THESE ACCEPTABLE USE COMMUNITY GUIDELINES, WHICH ARE ALSO INCORPORATED UNDER OUR FOLLOWING TERMS AND CONDITIONS (“T&Cs”):

The Discover Sport Platform is a community driven Content upload and viewing platform focusing on sporting activities, where you can upload, view and/or comment on Content.. The Discover Sport Platform aims to provide a friendly, safe and healthy environment to connect with fellow sports enthusiasts and accordingly our T&Cs (which include these Acceptable Use Community Guidelines) are core to realising this vision and ensuring enjoyable use of our Services.
Discover Sport simply provides the Platform and allow third parties/everyday persons to upload their sporting Content for the enjoyment of others, to engage with other Users and to build followers. The Content on the Platform does not necessarily reflect the opinion of Discover Sport and your use of the Platform is at your own risk, including the risk that you might be exposed to Content that is offensive, indecent, inaccurate, objectionable, or otherwise inappropriate.
1. DEFINITIONS
For the purposes of our T&Cs:
Content includes, but is not limited to, any information, data, communication, commentary, videos, stock images or footage, materials, writings, icons, text, graphics, lay-outs, images, sound clips, trade names, logos, domains, location data, trademarks and other intellectual property posted on the Platform by a User.
Discover Sport, us, our, or we means Discover Sport (Pty) Ltd (Registration number: 2023/921669/07) having its registered address at 76 Kyalami Boulevard, Kyalami Park, Gauteng, South Africa and the owner of the Discover Sport Services;
Discover Sport Content means Content that we create and make available in connection with the Platform.
Platform includes any website and/or any related (and/or enhanced) mobi-sites, software applications, embeddable video players or any other portals specifically made available by Discover Sport in relation to this platform;
Services includes the provision of the Platform to Users, the Discover Sport rewards programme and any supporting services;
Third Party Content means Content that originates from parties other than Discover Sport or its Users, which is made available in connection with the Platform;
Uploaders are those persons who create an account and upload and/or post Content to the Discover Sport Platform;
Users are both Uploaders and Viewers (including anyone who browses, scrapes, crawls or in any way uses the Platform);
User Content means Content that Users submit or transmit to, through, or in connection with the Platform, but excludes any approved advertising on the Platform;
Viewers are those persons viewing any content of Users on the Platform; and
you means, unless the context indicates otherwise, any User of our Services.
2. PROHIBITED CONTENT

3.1. Copyright/Intellectual Property Infringements
You are prohibited from posting any Content on our Platform that is not owned or licensed to you or in respect of which you do not have any right to post. This includes any Content containing third party music or stock images or footage. For more information on this, please see our Terms of Service. /static/terms-conditions/
If you upload any Content that infringes another person’s rights, it could lead to the Content being taken down, your account being suspended and/or rights of access to our Platform being terminated.
3.2. Privacy Infringements
Sharing personal information of other Users without their express permission is prohibited. For example, you may not share links to Users social media accounts or recordings or voice calls you may have had with a User or people’s name, surname, contact details , address or other similar information, without their permission
3.3. Pornography or Child Pornography
You are prohibited from uploading or posting any Content containing or promoting pornography, nudity, child pornography or which facilitates inappropriate interactions with, or exploitation of children
3.4. Illegal Content
Any Content that contains evidence or promotes the committing of a crime is prohibited. This includes, but is not limited to, buying or selling illegal drugs, weapons or counterfeit goods, committing or planning a murder or theft, engaging in any form of human trafficking, child pornography or the destruction or theft of property.
3.5. Bullying, Harassment or Hate Speech
You are prohibited from uploading or posting any Content motivated by hatred or prejudice including any Content that promotes or encourages discrimination, bullying, harassment or violence based on a person’s race, ethnicity, gender, sex, religion, sexual orientation, financial situation or disability (this list is not exhaustive).
3.6. Sensitive, Violent or Harmful Content
You are prohibited from uploading or posting any Content which promotes or encourages self-harm. This includes, but is not limited to, any Content that:
is life-threatening, lead to physical harm or encourages other to act in such manner;
promotes or encourages suicide or cutting or any form of self-mutilation;
promotes or encourages the use of illegal substances or overuse of legal substances; such as alcohol or over the counter medication; or
promotes or encourages eating disorders.
You are prohibited from uploading or posting any Content, which promoted violence, sexual violence and exploitation, terrorism or extremism. This includes Content that:
encourages use of weapons to harm or threaten others;
encourages others to harm others;
attempts to harm or kill others;
conains terrorist or extremist propaganda;
depicts non-consensual sexual acts; or
is revenge porn or offering revenge porn to others.
3.7. Offensive Content
You are prohibited from using account usernames or display names with offensive words or images in them. Furthermore, the uploading or posting of Content with vulgar language may be removed.
Discover Sport may take enforcement action as detailed in paragraph 5.2 below if it, at its sole discretion, determines any Content posted or uploaded to the Platform is offensive or likely to cause harm or loss to us, our Users or any third parties.
3.8. Spam and Unsolicited Activities
Any Content which harms or violates the integrity of our Services is prohibited. This includes, but is not limited to, posting spam, selling or using User accounts, artificially inflating viewer statistics, engaging in phishing, unsolicited promotions, mass mailing, political campaigning, sweepstakes, barter and pyramid schemes and alike.
3.9. Viruses, Malware and Alike
You are prohibited from using the Platform or any Content to transmit any malware, computer viruses, worms, defects, Trojan horses or other items of a destructive nature;
3.10. Impersonation or Misinformation
You are prohibited from uploading or posting Content which impersonates an individual or organisation.
You are also prohibited from sharing misinformation on our Platform. This relates to Users who systematically and continuously share misinformation both on our Platform and other platforms.
4. PROHIBITED PERSONS
Certain persons and/or organisations may be prohibited from using our Services. This includes terrorist organisations, gangs, cults, sanctioned persons and hate groups.
5. REPORTING PROHIBITED CONTENT AND/OR PERSONS
Anyone may report Content that violates our Acceptable Use Community Guidelines, any of our T&Cs or that they believed is offensive or illegal by clicking on the “Report It” button on the Platform and thereafter completing the required fields forming part of the report request.
6. REVIEW, COMPLAINTS ENFORCEMENT & APPEAL
6.1. Review and Complaints
We do not review all Content uploaded to our Platform. We will, however, review specific Content that is reported to us by Users, third parties and certain software systems.
Upon receipt of a report, the Content will be investigated and may be removed if we are of the view it is not compliant with our T&Cs (in particular these Acceptable Use Community Guidelines) or, in our sole discretion, otherwise warrants removal.
When we carry out our review of reported Content, we will first look at the Content against the reported violation and then consider the context. We may also potentially review the Content, together with other sources from the internet for example, regarding the particular User that uploaded the Content. We will then consider if a violation has occurred and, in our discretion, where we determine a violation has occurred we may remove the Content or take other enforcement action
We may elect not take any enforcement action where we have determined the Content is not a violation or if it can be justified, for example, has an artistic, documentary or educational context.
6.2. Enforcement
Users are liable and responsible for the Content that they post.
We are under no obligation to enforce the T&CS on your behalf against another User and we reserve the right to investigate and take appropriate action at our sole discretion.
Any breach of our T&Cs which includes these Acceptable Use Community Guidelines, may lead to the Content being removed, a User account being suspended or removed or access to our Platform being restricted.
We may modify, suspend, or terminate your access to, or use of our Services at any time for any reason in our sole discretion, including, but not limited to, in the event that we believe you have breached any of our T&Cs or caused, or may cause, harm or loss to us, our Users or any third parties.
We may also remove any of your Content which we believe, in our sole discretion, breaches any of T&Cs or may cause harm to us, our Users or any third parties.
We may also report you to the appropriate authorities or take other appropriate legal action.
